Terms of Service

The agreement between you and StaySonar: what the service does, what it does not promise, and what you agree not to do with it.

Draft — not yet in force. This document is missing the operating entity's registered details, which a privacy policy and terms of service are legally required to state. Fill in ss_legal_operator() in _legal_page.php and have the result reviewed by a lawyer in your jurisdiction before relying on it.

These terms govern your use of StaySonar. By creating an account you accept them. If you do not, please do not use the service.

1. Who you are contracting with

StaySonar is operated by [ENTITY — TO BE COMPLETED][ADDRESS — TO BE COMPLETED] ("we", "us"). "You" means the person or business using the service.

2. What StaySonar does

StaySonar checks the publicly visible availability calendars of Airbnb listings you choose, on a schedule, records what it finds, and tells you when a night changes between one check and the next.

It reads only what Airbnb already shows to anyone with the listing link. It never asks for or uses your Airbnb account.

3. What "booked" means, and what it does not

This is the most important limitation of the service, so it sits here rather than buried in a disclaimer.

Airbnb reports a night as unavailable without saying why. A real booking, a date the host blocked off, and a gap too short for the minimum stay all look identical from outside. StaySonar therefore reports what it can actually observe — that a night stopped being offered — and says "looks booked" rather than "was booked".

Occupancy percentages are an upper bound, not a booking count. You should treat everything StaySonar shows as an indicator to inform your own judgement, not as fact about another host's business. Do not rely on it as the sole basis for pricing, investment or any other commercial decision.

4. Accuracy and availability

The service depends on Airbnb continuing to publish data in a form we can read, and on third-party providers. Airbnb may change, restrict or block that access at any time, without notice to us. Checks may be delayed, incomplete or fail entirely.

We provide the service "as is". We do not warrant that it will be uninterrupted, that every change will be detected, or that every alert will arrive.

5. Your account

  • You must be at least 18 and able to enter into a contract.
  • Give accurate details and keep your password secure. You are responsible for what happens under your account.
  • One account per person or business unless we agree otherwise. Do not share logins.
  • Tell us promptly if you believe your account has been accessed by someone else.

6. Acceptable use

You agree not to:

  • Resell, redistribute or publish the data StaySonar collects, or present another host's availability as your own data or as a public dataset.
  • Use the service to harass, target or identify any individual.
  • Attempt to circumvent plan limits, rate limits or access controls, or to access accounts or data that are not yours.
  • Use automated means to extract data from StaySonar itself, or resell access to it.
  • Use the service unlawfully, or in breach of any third party's terms — including Airbnb's.

We may suspend or close an account that breaches this section.

7. Your responsibility for how you use the data

You decide which listings to track and what to do with what you learn. Competition, data-protection and unfair-practices law differs by country, and complying with the law that applies to you is your responsibility, not ours.

8. Relationship with Airbnb

StaySonar is not affiliated with, endorsed by, or connected to Airbnb, Inc. "Airbnb" is their trademark, used here only to describe what the service reads. We have no agreement with Airbnb, and access to the data we read is not guaranteed.

9. Trial, plans and payment

  • New accounts start with a 3-day free trial. Plans differ only in how many listings you may track; every plan checks every listing on the same schedule.
  • When the trial ends without a paid plan, your account becomes read-only: your calendars, history and alerts stay visible, and adding new listings stops. We do not delete your data when a trial lapses.
  • Fees are stated on the pricing page and charged in advance for the period you choose. Yearly plans are charged once for the year.
  • Refunds are covered by the Refund Policy, which forms part of these terms.
  • We may change prices. Existing subscribers will be told before a change affects them, and may cancel instead.

10. Cancelling

You can stop using StaySonar at any time. Cancelling stops future charges; you keep access until the end of the period you have paid for. To close your account and delete your data, email [email protected].

11. Suspension and termination by us

We may suspend or terminate an account that breaches these terms, that we are legally required to act on, or that is causing harm to the service. Except where a breach makes it inappropriate, we will give notice and a chance to put things right, and will refund any unused prepaid period.

12. Liability

Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.

Otherwise, and to the extent the law allows: we are not liable for lost profits, lost revenue, lost bookings, or indirect or consequential loss; and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

In particular, we are not liable for decisions you take based on StaySonar's data — see section 3 for why that data is an indicator rather than a fact.

13. Changes to these terms

We may update these terms. The date at the top always shows the current version, and we will email you before a material change takes effect. Continuing to use the service after that means you accept the new terms.

14. Governing law

These terms are governed by the law of [JURISDICTION — TO BE COMPLETED], and disputes are subject to the courts of [JURISDICTION — TO BE COMPLETED]. If you are a consumer, this does not remove protections you have under the law of your own country of residence.
